Constitutional reform: 1in.am

Even if the model of the constitutional government theoretically opened a door for the formation of a multi-vector authority in Armenia, these days that opportunity is consistently “edited” by the draft laws on “Bodies of State Governance” and “Government Structure and Practice”. These drafts are completely contradictory to the parliamentary governance system and in this context Armenian “parliamentarism” has not a single connection to the international practice and, in essence, it has an inclination towards preserving or developing the authoritarian, self-centered and pyramidal system.  

It is difficult to find any other country with a parliamentary governance system where, in essence, the whole security system – Police, NSS, is left beyond the control of the Parliament, even the collegial governance of the government.  

According to the represented drafts, the aforementioned force structures will be entities subject to the PM, which means that regardless of the change of the governance system, today’s status quo will be preserved April onwards, or the pyramidal governance system will be legally deepened even further.  

The mentioned will result in the deepening of repressive and corruption risks in force segment which is an ordinary phenomenon to the authoritarian countries. That is, Armenia legally develops its legal grounds of authoritarian state under the veil of parliamentary governance system. The draft bills import innovations which totally re-establish the evil traditions of the Soviet rule, recording a regress even as compared with today’s reality. For example, since April the government will hold closed-door sessions, the right of the government members of giving interviews and expressing personal opinion will be restricted legally, the MPs will be deprived of the right to participate in the sessions of the Cabinet.

All this breaks the principles of the public activity and accountability of the executive power, which are a compulsory condition for any given democratic state and parliamentary model.
