On June 27, at the NA extraordinary session the issue of the election of the judges of the Administrative Chamber of the Court of Cassation.
The member of the Supreme Judicial Court Davit Khachaturyan presented the biographical data and the passed path of Artur Arakelyan, Ara Babayan and Artsrun Mirzoyan.
The candidate for the judge of the Administrative Chamber of the Court of Cassation Artur Arakelyan, presenting his vision, noted that the ideal or almost ideal model of the separation of the authorities implies the legislatively balanced independence of the legislative, executive and judicial authorities, when everybody from the state bodies carried out the functions reserved to him by legislation, without replacing each other and guaranteeing the effective function of not only its, but other branches of power. “The final goal of the implementation of the authorities’ principle of separation is the united provision of the state power regulated through creating of constitutional structure,” Artur Arakelyan said.
The NA deputy Heriknaz Tigranyan was interested in the candidate’s opinion on vetting. Artur Arakelyan noted that it is of priority to understand what is the vetting in general, after that understand if its use is necessary or not. “In my opinion, it is not right to carry out pervasive actions on any issue, we shall approach to any issue, to any person’s any problem with the issues related to that problem. Individual approach should be on any person.”
The next candidate, Ara Babayan noted that the activities of the Administrative Chamber will promote the rise of the administrative justice, giving an opportunity to fully carry out the mission of the Court of Cassation, to ensure the same use of the laws and other normative-legal acts, as well as to eliminate the fundamental violation of human rights and freedoms. In the implementation of that most important mission Ara Babayan expressed readiness for having his contribution to it.
The third candidate Artsrun Mirzoyan also highlighted the creation of the separate specialized chamber in the Court of Cassation. He touched upon the activities of the Administrative Court, the peculiarities of the institute of the judicial precedent, the issue of accepting the complaints being submitted to the Court of Cassation into proceedings, voiced his ideas characterizing the judge’s building integrity. According to the candidate, the right of the justice accessibility should be real and effective. The person has an opportunity to dispute any intervention impeding the implementation of his/her rights.
The questions of the deputies Vladimir Vardanyan and Sergey Bagratyan addressed to the candidates related to the role of the Administrative Chamber of the Court of Cassation in unloading the courts, the reasons of the delay of the judicial cases, because of which negative attitude is formed towards the system among the public.
